The conditional interpretation of general categorical statements like ‘All men are animals’ as universally quantified material conditionals ‘For all x, if x is F, then x is G’ suggests that the logical structure of law statements is conditional rather than categorical. Disregarding the problem that the universally quantified material conditional is trivially true whenever there are no xs that are F, there are some reasons to be sceptical of Frege’s equivalence between categorical and conditional expressions. -/- Now many philosophers will (...) claim that the material conditional interpretation of laws statements, dispositions ascriptions, or any causal claim is generally accepted as wrong and outdated. Still, there seem to be some basic logical assumptions that are shared by most of the participants in the debate on causal matters which at least stems from the traditional truth functional interpretation of conditionals. This is indicated by the vocabulary in the philosophical debate on causation, where one often speaks of ‘counterfactuals’, ‘possible worlds’ and ‘necessity’ without being explicit on whether or to what extent one accepts the logical-technical definition of these notions. To guarantee a non-Humean and non-extensional approach to causal relations, it is therefore important to be aware of the logical and metaphysical implications of the technical vocabulary. -/- In this paper we want to show why extensional logic cannot deal with causal relations. Via a logical analysis of law-like statements ‘All Fs are Gs’ we hope to throw some new light on interrelated notions like causation, laws, induction, hypotheticality and modality. If successful, our analysis should be of relevance for a deeper understanding of any type of causal relations, whether we understand them to be laws, dispositions, singulars or categoricals. The main aim of this paper is to examine the practice of describing intellectual pursuits in aesthetic terms, and to investigate whether this practice can be accounted for in the framework of a standard conception of aesthetic experience. Following a discussion of some historical approaches, the paper proposes a way of conceiving of aesthetic experience as both epistemically motivating and epistemically inventive. It is argued that the aesthetics of intellectual pursuits should be considered as central rather than marginal to our (...) philosophical accounts of aesthetic experience, and that our views about the relation between the aesthetic and cognitive domains should be reconfigured accordingly. Recently, cognitivist accounts about art have come under pressure to provide stronger arguments for the view that artworks can yield genuine insight and understanding. In Gregory Currie’s Imagining and Knowing: Learning from Fiction, for example, a convincing case is laid out to the effect that any knowledge gained from engaging with art must “be judged by the very standards that are used in assessing the claim of science to do the same” (Currie 2020: 8) if indeed it is to count (...) as knowledge. Cognitivists must thus rally to provide sturdier grounds for their view. The revived interest in this philosophical discussion targets not only the concept of knowledge at the heart of cognitivist and anti-cognitivist debate, but also highlights a more specific question about how, exactly, some artworks can (arguably) afford cognitive import and change how we think about the world, ourselves and the many events, persons and situations we encounter. This paper seeks to explore some of the ways in which art is capable of altering our epistemic perspectives in ways that might count as knowledge despite circumventing some standards of evidential requirement. In so doing we will contrast two alternative conceptions of how we stand to learn from art. Whereas the former is modelled on the idea that knowledge is something that can be “extracted” from our experience of particular works of art, the latter relies on a notion of such understanding as primarily borne out of a different kind of engagement with art. We shall call this the subtractive conception and cumulative conception respectively. The cumulative conception, we shall argue, better explains why at least some insights and instances of knowledge gained from art seem to elude the evidential standards called for by sceptics of cognitivism. Can there be a philosophy of taste? This paper opens by raising some metaphilosophical questions about the study of taste – what it consists of and what method we should adopt in pursuing it. It is suggested that the best starting point for philosophising about taste is against the background of 18th-century epistemology and philosophy of mind, and the conceptual tools this new philosophical paradigm entails. The notion of aesthetic taste in particular, which emerges from a growing sense of dissatisfaction (...) with an undifferentiated category of taste, comes to be set apart from gustatory taste on account of its normativity and aspirations to objectivity. The paradox of taste, as found in Hume and Kant, is examined, and shown to be highly relevant to contemporary metaphysical debate within aesthetics. Specifically, this paper argues that both Realists and Anti-Realists rely more heavily than assumed on the idea of taste. (shrink)

In this paper I distinguish between different kinds of failures of aesthetic judgements with a view to exploring a form of failure that involves the outright omission of aesthetic judgement. Such omissions come to pass when an object of attention could or ought to have been experienced and judged aesthetically but where such an experience or judgement simply failed to arise, and can be traced back to at least three kinds of reason: (1) lack of aesthetic quality; (2) lack of (...) appropriate ontological status; and (3) lack of aesthetic prominence. I shall examine some aspects of this kind of failure and argue that a missed opportunity to experience an object of attention’s aesthetic character is a missed opportunity to engage with that object’s aesthetic potential where such potential, although not always accessible to us, can nonetheless retroactively be said to pertain to the object in a meaningful sense also under experientially unfavourable conditions. The experience of grace is currently attracting increased empirical interest. Validated instruments to assess aspects of the experience of grace in a secularized context are scarce which limits current psychological research on grace in other than highly religious populations. We present a bottom-up construction of the Experiencing Grace Scale (EGS) and evidence supporting its reliability and validity. Confirmatory factor analysis showed a good fit for the four subscales: Appraising Grace, Giving Grace, Receiving Grace, and Divine Grace. Reliability analysis showed overall (...) good internal consistency and test–retest stability. Convergent validity was demonstrated by means of expected associations between subscales of the EGS and other relevant measures. Predictive validity was confirmed by associations between subscales of the EGS at measurement Wave 1 with mental well-being scales at Wave 2. The EGS contributes to further research on the experience of grace and its relationship to other psychosocial variables in the field of positive psychology. (shrink)

What is the value of art? Standard responses draw on the different kinds of value that we tend to ascribe to individual artworks. In that context, none have been more significant than aesthetic value and moral value. To understand what makes an artwork valuable we then need to examine the interaction between these two kinds of value and how this contributes to the artwork's final value. The main aim of this article is to highlight two areas of concern for interaction (...) theories, in order to improve our understanding of the dynamic relations between kinds of value in art. In the first instance, I shall outline the main tenets of the three leading interaction theories. Next, I shall discuss what it might mean to say that an artwork has moral value, in an attempt to establish on what grounds interaction theories base their central claims. Subsequently, I will look at how our conception of art's moral value affects the possibility of a bona fide form of value interaction, or one capable of shaping a work's final value in conjunction with its aesthetic value. Finally, I shall turn to a discussion of the notion of aesthetic value. (shrink)

The principal concern of my paper is a distinction between two ways of appreciating works of art, characterised here in terms of the phrases ‘seeing is believing’ and ‘believing is seeing’. I examine this distinction in the light of an epistemological requirement at times at least grounded in what David Davies, in his Art as Performance , refers to as the ‘common sense theory of art appreciation’ in order to assess exactly what aspect of the philosophical approach generally known as (...) aesthetic empiricism his account commits him to reject. I argue that the ‘experiential requirement’, if only conceived in a slightly broader way than is usual, might very well have an important role to play not only in the appropriate appreciation of works that do not demonstrate the need for such a requirement (primarily works of late modern and conceptual art), but also in the ontological account Davies himself favours. This paper has two main aims. The first is to examine our normative relations to artworks and cultural artefacts threatened by damage or destruction. The second aim is to develop an argument for the notion of aesthetic obligation, offering an alternative model of explanation of our normative relations to artworks and cultural artefacts which relies neither exclusively on the object of appreciation (‘object-oriented approach’) nor on the appreciating subject (‘subject-oriented approach’). Instead, an aesthetic obligation is held to be directed primarily (...) towards the community which appreciates the object on the grounds of its aesthetic value. That which unites an aesthetic community is the practice of valuing an object for its aesthetic character. The notion of aesthetic obligation thus relies both on the community of subjects which holds an object in high aesthetic regard and that same object’s aesthetic value. (shrink)

Moving from a critical assessment of some recent attempts to define the arts in terms of adaptations, spandrels, by-products and, moreover, calling into question the continued development of the concept of the "aesthetic" in the frame of contemporary interdisciplinary research projects, the main aim of this paper is to highlight some of the ways in which archaeological objects can, at least in some respects, testify to the manifestation of the modern aesthetic mind.

Two common strategies have dominated attempts to account for the nature of taste. On the one side, we have an affectivist understanding of taste where aesthetic attribution has to do with the expression of a subjective response. On the other side, we find a non-affectivist approach according to which to judge something aesthetically is to epistemically track its main aesthetic properties. Our main argument will show that neither emotion nor perception can explain the nature of aesthetic taste single-handedly. In this (...) paper, our principal aim is to examine the relationship between perceptual discernment and emotional sensibility as we find it in the process of ascribing aesthetic qualities. Is it the nature of the specific aesthetic property in question which determines the way in which perception and emotion are balanced in aesthetic attribution, or is it, rather, something about how our sensory skills operate? One of the notions we would like to explore in greater detail in this context is the idea of attunement, or the way in which aesthetic agents can align themselves to the content of an artwork o in order to better grasp its content and significance. According to our proposed picture, the exercise of taste involves an adjustment of one’s emotional sensibility to the aesthetic character of o. A person can appropriately manifest respect toward a world heritage ruin by developing a sensitive understanding of the ruin’s cultural and historical context and significance. In this paper, we link such respectful understanding to the question of the aesthetic appreciation of world heritage ruins. Our claim is that an aesthetic appreciation of a world heritage ruin qua world heritage ruin typically involves two things: first, the responsibility not to neglect the individuality of the object, and, second, a commitment to the (...) idea that it is the object—respectfully conceived—which must be the focus of our appreciation. This paper defends a ‘noetic’ conception of aesthetic experience whereby such experience is best conceived as a kind of explorative thought process. Although not directly aimed at acquiring knowledge, this process often leads to an enhanced understanding or improved epistemic grasp of the object of appreciation itself and the world. On this conception, aesthetic value acts as an invitation to engage in a series of contemplative and reflective processes during which we rely not only on the perceptual, imaginative, and affective (...) abilities which have occupied such a central role in aesthetic theory, but also on our capacities for sense-making, problem-solving and theory-building. This paper examines what role the law can and should play with regard to unreliable information available on fast communication networks, such as the Internet. Users of electronic information find it increasingly difficult to assess its reliability. The traditional structures for assessing reliability are lacking or function inadequately. Clear social norms have not yet been developed. As regards the law, traditionally liability law is the first legal guard against undesirable societal developments. We conclude however, that liability law is an inadequate (...) remedy for unreliable information. Self‐regulatory initiatives such as trust mark seals for websites providing reliable information offer a more promising perspective, although these also have their limitations, especially in the sphere of enforcement and legitimacy. In this paper, self‐regulation is nonetheless hailed as an important instrument because it provides an indispensable test‐bed for more concrete legal norms derived from reliability criteria for information. Even if self‐regulation may not completely materialise, discussion about self‐regulation could be a stepping stone to the development of pertinent social norms. (shrink)

This doctoral thesis is an examination of the possibility of ascribing objectivity to aesthetic judgements. The aesthetic is viewed in terms of its being a certain kind of relation between the mind and the world; a clear understanding of aesthetic judgements will therefore be capable of telling us something important about both subjects and objects, and the ties between them. In view of this, one of the over-riding aims of this thesis is the promotion of an ‘aesthetic psychology’, a philosophical (...) approach, that is to say, which emphasises the importance of the psychological processes involved in the making of aesthetic judgements. One of the aims of this thesis is to develop a revisionary account of the distinction between objectivity and subjectivity in the domain of value. This revision will undertake to dismantle some of the assumptions implicit in a metaphysical framework which traditionally ascribes objectivity only to judgements about facts, and not to judgements about values and other concerns such as norms and emotions. Further, the thesis examines the intricate ways in which aesthetic properties, the focus of aesthetic judgements, depend on the (emotional and other) responses of the subjects of experience. The particular role played by first-hand experience in the making of aesthetic judgements is among the things critically investigated in the interests of reaching a clearer understanding of the manner in which aesthetic judgements may be objective in the sense of being justifiable. Eventually, a defence is outlined of the view that aesthetic judgements can be supported by good reasons, but not in the same way as ordinary cognitive judgements. Finally, I outline the main tenets of a proposed ‘reasonable objectivism’ for aesthetic judgements, an objectivism grounded on justifying reasons. (shrink)

This paper is concerned with the possibility of an objectivism for aesthetic judgements capable of incorporating certain ‘subjectivist’ elements of aesthetic experience. The discussion focuses primarily on a desired cognitivism for aesthetic judgements, rather than on any putative realism of aesthetic properties. Two cognitivist theories of aesthetic judgements are discussed, one subjectivist, the other objectivist. It is argued that whilst the subjectivist theory relies too heavily upon analogies with secondary qualities, the objectivist account, which allows for some such analogies at (...) the epistemological level, is too quick to ground aesthetic judgements in perceptual experiences alone. Further, it is held that aesthetic justification can, contra the objectivist theory under scrutiny, be based on an appeal to generally available justifying reasons without overthrowing the non-inferential character of aesthetic judgements. This possibility relies on a clearly established delineation between (i) aesthetic perception and aesthetic judgement, (ii) justifying reasons and explaining reasons, and (iii) judgement-making and judgement-justification. The last decade has seen a significant increase in empirical research into the nature of art and aesthetic experience in the Anglo- American scientific community. Much of the impetus for this came from the publication of three special issues of the present journal on the theme of 'Art and the Brain' . A decade or so later, it seems timely to consider the extent to which these new approaches have filtered through into wider philosophical understanding. Many philosophers express scepticism towards (...) empirical aesthetics. This paper seeks to re-examine the grounds for any such scepticism and proposes a new reading of the explanatory power of scientific approaches. It begins by separating the data provided by such theories into three categories. Having identified a particular conceptual problem, it argues that many empirical accounts fail to distinguish sufficiently between the aesthetic and the artistic, and that this is a source of considerable philosophical concern. It then suggests that empirical aesthetics should be divided into two branches, namely empirical aesthetics and empirical art theory. Although such a division may seem to restrict the explanatory reach of scientific accounts somewhat in philosophy, it highlights the numerous ways in which empirical investigations can nonetheless strengthen and benefit philosophical analyses. This paper highlights the dark side of power imbalance regarding its consequences in agri-food supplier–buyer relationships. We report on findings from two studies. The first study is based on a sample of 105 key informants, while study 2 is based on a sample of 444 key informants, all from the cocoa agri-food supply market of Ghana. While the first study focuses on the antecedents of power imbalance and its consequences, the second study explores the role of cooperatives/collective action in minimizing (...) supplier exploitation. Data from these studies were analysed using the partial least squares technique. Analysis of these findings shows switching costs’ impact on power imbalance to be curvilinear, while power imbalance has a curvilinear relationship with opportunism. The negative consequences of power imbalance are further exacerbated by dependency and the lack of joint action. Furthermore, we found the negative impact of power imbalance on financial performance to be stronger for non-cooperative members than for cooperative members, while, counterintuitively, we found the positive impact of economic satisfaction on financial performance to be stronger for non-cooperative members than for cooperative members. Software agents that play a role in E-commerce and E-government applications involving the Internet often contain information about the identity of their human user such as credit cards and bank accounts. This paper discusses whether this is necessary: whether human users and software agents are allowed to be anonymous under the relevant legal regimes and whether an adequate interaction and balance between law and anonymity can be realised from both the perspective of Computer Systems and the perspective of Law.

This paper argues that the technical notion of conditional probability, as given by the ratio analysis, is unsuitable for dealing with our pretheoretical and intuitive understanding of both conditionality and probability. This is an ontological account of conditionals that include an irreducible dispositional connection between the antecedent and consequent conditions and where the conditional has to be treated as an indivisible whole rather than compositional. The relevant type of conditionality is found in some well-defined group of conditional statements. As an (...) alternative, therefore, we briefly offer grounds for what we would call an ontological reading: for both conditionality and conditional probability in general. It is not offered as a fully developed theory of conditionality but can be used, we claim, to explain why calculations according to the RATIO scheme does not coincide with our intuitive notion of conditional probability. What it shows us is that for an understanding of the whole range of conditionals we will need what John Heil (2003), in response to Quine (1953), calls an ontological point of view. (shrink)

In the context of a broad welcome to Bullot & Reber's (B&R's) proposals concerning the incorporation of contextual awareness into the study of the psychology of art appreciation, I raise two concerns. First, the proposal makes no allowance for degrees of relevance of contextual awareness to appreciation. Second, the authors assume that and can be maintained as separate phases or modes, but this may be more problematic than anticipated.

Software agents extend the current, information-based Internet to include autonomous mobile processing. In most countries such processes, i.e., software agents are, however, without an explicit legal status. Many of the legal implications of their actions (e.g., gathering information, negotiating terms, performing transactions) are not well understood. One important characteristic of mobile software agents is that they roam the Internet: they often run on agent platforms of others. There often is no pre-existing relation between the owner of a running agents process (...) and the owner of the agent platform on which an agent process runs. When conflicts arise, the position of the agent platform administrator is not clear: is he or she allowed to slow down the process or possibly remove it from the system? Can the interests of the user of the agent be protected? This article explores legal and technical perspectives in protecting the integrity and availability of software agents and agent platforms. Farrell’s Norms of Rhetorical Culture (1993, 6) remains both a masterly synthesis of previous constructive work in rhetorical theory and the essential starting point for anyone committed to reconciling the practical impulses of Aristotelian rhetoric, ethics, and politics with (...) the critical imperatives of modernity. In what follows, I try to make a very simple point about Farrell’s recuperation of Aristotelianism: he neglects matters of social causation and institutional design that were essential to Aristotle’s understanding of rhetoric. In turn, by displacing the social in favor of the cultural—a displacement characteristic of much recent work in the human sciences (Schudson 1997)—Farrell lacks a coherent account of the gap between the normative aspirations of classical rhetoric and the empirical characteristics of public life in modern liberal democracies.The problem appears most clearly in chapter 7 of Norms : “Criticism, Disturbance, and Rhetorical Community.” Farrell defines culture as “the common definition of places for the invention and perpetuation of meaning. A culture offers to those who live in it symbols and families of practices that [End Page 402] permit ongoing performances of meaning and value” (1993, 277). Summarizing his previous arguments, Farrell contends that Aristotle’s Rhetoric informs modern “cultural occasions” in three ways: “the impetus for rhetorical meaning, which we find in Aristotle’s seminal understanding of phronēsis, typified by deliberative prudence; a concept of rhetorical form, which we have found in the prototype for public inference and judgment—the enthymeme; and a modern rhetorical forum, a space of engagement wherein the modern constraints of rhetorical culture might assert themselves” (1993, 277). Although these three concepts are inherently useful, both for analyzing past rhetorical episodes and for projecting emancipatory rhetorical possibilities in the present, they are insufficiently grounded in a historical account of the differences between ancient and modern prudential deliberation, rhetorical forms, and rhetorical forums. An adequate history of these differences would require attention to modern social systems as a whole, which include the economy, the polity, and social institutions such as the family, schools, religious and ethnic organizations, and, most crucially for contemporary social systems, the entire apparatus of the culture industry, including the news and entertainment “media.”The cultural aspect of the modern social system, loosely following Talcott Parsons (1951), includes norms, which make for communal solidarity, and values, which undergird the whole system. Although a thoroughgoing account of the place of rhetoric in the entire contemporary social system of a modern liberal democracy such as the United States or Canada would have required a book three times as long as Norms, there are three ways in which modernity complicates the appropriation of Aristotle’s concepts. First, rhetorical meaning is very different in a social system in which individual autonomy takes precedence over communal solidarity as a fundamental value (Pippin 1999). Second, rhetorical forms function differently in a social system in which those forms can be commodified (Aune 1994, 2001). Third, rhetorical forums are also far more complex, especially in an extended republic like Canada or the United States, requiring greater attention to the way in which constitutions literally create persons who speak (such as the president or prime minister) and spaces for speaking (Congress, the state or provincial houses [White 1984]). The need to raise massive sums of money to obtain media access for common rhetorical deliberation, as is especially the case in the United States, complicates the notion of a rhetorical forum immensely. At the beginning of the article, Habermas praises Aristotle's Politics for its union of normative theorizing and empirical research, forgetting apparently that Aristotle also wrote a normative and empirical Rhetoric.That Habermas distrusts persuasion is obvious, but what is less clear is how the rhetoriphobia he shares with virtually every modern and contemporary philosopher came about. Bryan Garsten's book—the most important work on rhetoric and political philosophy since Ronald Beiner's Political Judgment—makes the startlingly original argument that the anti-rhetorical stance not only is grounded in a suspicion of private judgment, but that it can be traced back to Hobbes's, Rousseau's, and Kant's fear of the persuasive power of post-Reformation religious enthusiasm. Garsten not only provides provocative rereadings of these three fathers of modern liberalism but also extends our understanding of rhetorical and political judgment in Aristotle and Cicero. His analysis of the problems of persuasion and democracy in the twentieth century, while somewhat less satisfying, includes cogent criticisms of Rawls, Habermas, and theorists of deliberative democracy from what might be called a Ciceronian-Madisonian republican stance. [End Page 94]Saving Persuasion began as a doctoral dissertation in Government at Harvard, under the direction of Harvey Mansfield—after Allan Bloom, perhaps the most influential and controversial of the disciples of Leo Strauss. Although Garsten's book displays both the virtues and vices of Straussianism, it would be unfair to dismiss it as a neoconservative manifesto for rhetoric. (An enthusiastic review of the book appeared in the neoconservative Weekly Standard in February 2007, illustrating the curious fact that the Right "gets" rhetoric in ways that liberals and leftists do not (Deneen 2007).) Garsten thus combines the Straussian emphasis on close reading with the contextual-rhetorical perspective of Skinner; this unique synthesis enables Garsten to solve some ongoing problems in textual interpretation (especially the relationship between Academic skepticism and Stoic natural law theory in Cicero) while developing interesting causal arguments about the rise of the public sphere in the eighteenth century, the decline of interest in rhetoric by liberal political theorists, and the pathologies of contemporary democratic politics.The book is divided into two main parts, following an introduction in which Garsten lays out his central thesis: "[A] politics of persuasion—in which people try to change one another's minds by appealing not only to reason but also to passions and sometimes even prejudices—is a mode of politics worth defending. Persuasion is worthwhile because it requires us to pay attention to our fellow citizens and to display a certain respect for their points of view and their judgments" (3). Cloud (1994, 2001a, 2001b, 2002) and James Arnt Aune (1994, 2001). These essays usefully point up what is at stake in the debate between poststructuralist theory and Marxism: whether an instrumental, class-based, socialist critical and political project is still feasible and necessary in today's world. Rejecting both Aune's Marxist-humanist approach and Cloud's more economic vision of agency, Greene claims that the changing character of global capitalism and recognition of the "constitutive power" of discourse render rhetorical criticism and practical politics on a Marxist basis untenable. Although we appreciate Greene's engagement with Marxism, we contend that the arguments sketched out in his essays are theoretically and politically flawed.First, Greene's criticisms are directed against a crude caricature of Marxist epistemology that obscures the complexity of theories of representation and ideology in the historical materialist tradition. [End Page 72] Real Lies: The Complexity of Marxist Epistemology Greene and other poststructuralists charge Marxist theorists in the field of rhetorical studies with holding a dubious representational theory of truth.1 In contrast, Greene embraces a critical approach that examines "how rhetorical practices create the conditions of possibility for a governing apparatus to judge and program reality" and that views "what is in the true" as rhetorically produced (1998, 22). At odds with Greene's approach, Marxists claim that, in a range of ways, ideological discourses reflect, distort, and/or negotiate with the objective social realities, interests, and lived experiences of contending classes in capitalist society. Moreover, we believe that—by means of interpretive, historical, and empirical research—Marxist scholars and activists may develop fuller and more accurate theoretical "representations" of such realities and interests and of the various ways they shape our lives and our political struggles.2This is not to say, however, that the process is simple or mechanistic. Marxist critical practice retains the evaluative power of realism without laying claim to absolute or unmediated empirical knowledge; moreover, we do not believe that ideas are mechanistically generated epiphenomena of economic motive. Discourses, as any communication scholar would agree and as Greene points out, do have effects or "effectivities." Yet anyone interested in a normative political project (which Greene wishes to escape, a point to which we shall return) must recognize the possibility of falsehood. (Revised) belief states are not closed under classical logical consequence; revising by inconsistent information does not perforce lead to trivialization; and revision can be subject to ‘framing effects’: logically or necessarily equivalent contents can lead to different revisions. We present a solution to the paradox of free choice permission by introducing strong and weak permission in a deontic logic of action. It is shown how counterintuitive consequences of strong permission can be avoided by limiting the contexts in which an action can be performed. This is done by introducing the only operator, which allows us to say that only is performed (and nothing else), and by introducing contextual interpretation of action terms.

In the Igbo traditional setting, the rules of law are uncodified.
